These Terms & Conditions of Sale govern the sales relationship between SERPENTI (hereinafter referred to as the “Seller”) and any individual or legal entity making a purchase through the website www.maar.it (hereinafter referred to as the “Customer”). They govern all stages of the ordering process, payment, delivery and order follow-up.
I. Applicability of the Terms & Conditions
Any order placed on the website www.maar.it implies full, unconditional and unreserved acceptance of these Terms & Conditions of Sale. The Customer acknowledges having read these terms before validating an order and declares full acceptance thereof. The Seller reserves the right to amend these Terms & Conditions of Sale at any time. The applicable terms are those in force on the date the order is placed. The fact that the Seller does not invoke any provision of these Terms & Conditions at a given time shall not be interpreted as a waiver of the right to invoke it at a later date.
II. Account Creation
Placing an order requires the prior creation of a customer account on the website www.maar.it. Upon registration, the Customer undertakes to provide accurate, complete and up-to-date information. The Customer guarantees the accuracy of the information provided and undertakes to update it whenever necessary. Once registration has been completed, the Customer will receive an email confirming the creation of the account. The Seller cannot be held liable for any inability to deliver an order resulting from inaccurate or incomplete information provided by the Customer during registration or at the time of ordering.
III. Orders
Validation of an order on www.maar.it constitutes an electronic signature and represents definitive acceptance of the order and of these Terms & Conditions of Sale. All data recorded by the Seller shall constitute proof of the transactions carried out between the Seller and the Customer. An order confirmation email will be sent to the Customer. The Seller deliberately maintains limited quantities in order to preserve the rarity and exclusivity of the pieces offered. Orders are fulfilled subject to stock availability. In the event that a product becomes unavailable after an order has been placed, the Customer will be informed as soon as possible. The Seller cannot be held liable for the cancellation of an order resulting from product unavailability. The Seller also reserves the right to refuse or cancel any order in the event of supply difficulties, an obvious error regarding a product or its price, suspected fraud or any other legitimate reason.
IV. Right of Withdrawal
In accordance with Articles L.221-18 and following of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of the products to exercise the right of withdrawal without having to provide any reason. Any request to withdraw must be sent by email to ciao@maar.it. Products must be returned within a maximum period of fourteen (14) days following notification of withdrawal. Items must be returned in their original condition, unworn, unused and accompanied by their original tags and packaging. Return shipping costs remain the responsibility of the Customer. Refunds will be processed within a reasonable period after receipt and inspection of the returned items, using the same payment method used for the original purchase. The Seller reserves the right to refuse a refund for any item returned incomplete, worn, damaged or not complying with these return conditions.
V. Products
The products offered for sale are those displayed on the website on the day of consultation by the Customer, subject to availability. The Seller takes the greatest care in the presentation, photography and description of the products in order to provide clear and accurate information. The photographs displayed on the website represent the products offered for sale. However, slight variations may occur depending on screen settings, lighting conditions and the colour rendering specific to each device. The products offered by the Seller come from a curated selection of brands and may present characteristics specific to each designer, particularly regarding cut, materials, finishes or artisanal manufacturing processes. The Customer acknowledges that an item previously returned by another customer may be offered for sale again, provided that it has been inspected and fully meets the Seller’s quality standards.
